Co-Chair of the Retail Development and Leasing Team Tara Scanlon and Real Estate Partners Janis Schiff and Jim Mayer will speak at the ICSC U.S. Shopping Center Law Conference.

Ms. Scanlon will moderate a workshop titled "Leasehold Mortgage Overview." She will cover the rating agencies requirements for a credit ground lease in connection with underwriting a leasehold mortgage. Ms. Scanlon will also discuss sample leasehold mortgage lease clauses from a landlord and tenant perspective and key leasehold mortgage provisions.

Ms. Schiff will moderate a workshop titled "Outparcel Leasing and Development." This workshop will be presented from both the landlord and tenant perspective and will focus on the unique development and operational challenges and issues relating to the leasing of outparcels in a variety of retail contexts including strip centers, mixed use projects, lifestyle centers and malls. Ms. Schiff will approach this topic and the issues by discussing actual project and user scenarios.

Mr. Mayer will moderate a workshop titled "Who Says that Brokerage and Management Agreements are not Negotiable?" He will discuss from the owner’s and manager’s/broker’s perspective many of the major issues in negotiating brokerage and management agreements. Mr. Mayer will educate the audience on how to respond to the first draft of these documents, recognize the major issues from both parties’ perspectives and how to negotiate them. The resulting agreement will hopefully be a fair and equitable document where both sides have adequate protections but are also able to carry out their respective duties.

In addition, the following Real Estate attorneys will lead roundtable discussions on October 27.

National Retail Development and Leasing Team Co-Chair Deb De Luca is serving as a member of the conference planning committee and will be in attendance as well.
