Acquired Rights in Environmental Matters: The Vase of Llorente

Environment attorney Estefanny Pardo published a column in Asuntos Legales about the concept of acquired rights in environmental matters in Colombia. Ms. Pardo explains that the environmental authorities and central government have argued that acquired rights do not exist in mining concession contracts, citing some sentences from the Supreme Court, and because of that have sought to prohibit and limit mining in the country. However, she says, this interpretation is incomplete and ignores other pronouncements from the court.
