Another Potentially Bubbly Battle Over Hydrogen Peroxide Fizzles Out

Litigation attorneys Jessica Farmer and Amy McVeigh co-authored a blog in Drug & Device Law discussing the result of recent legal battles over hydrogen peroxide's labeling. The plaintiff claimed the packaging of the over-the-counter product was misleading as it used the words "treatment," arguing the product does not treat or cure wounds. Instead, the product simply cleans them. The Western District of Michigan, using Novotney’s reasoning, ruled the labeling of hydrogen peroxide followed U.S. Food and Drug Administration (FDA) standards, siding with defendants who argued the FDA used the word "treat" to mean "give medical care." The court also struck down a claim the labeling violated federal law.
