Anticipating USMCA Dispute Over Digital Censorship Injunction

Intellectual Property attorney José Luis Villareal was quoted in an article by Reforma, highlighting the dispute resolution mechanism under Chapter 31 of the United States-Mexico-Canada Agreement (USMCA) as the appropriate recourse in the event that any party believes the inapplicability of articles deemed unconstitutional constitutes a violation of Article 20.88 and other relevant provisions of the USMCA. The statement came in the context of a discussion about the 2020 amendments to the Federal Law of Copyright in Mexico, which have raised significant concerns regarding freedom of expression and the balance between copyright protection and individual rights. 

"The proper course of action would be the dispute resolution mechanism as outlined in Chapter 31 of the USMCA, should any party believe that the inapplicability of articles deemed unconstitutional constitutes a breach of Article 20.88 and other relevant provisions of the USMCA," he said
