The New Decree on Natural Reserves Worsens the Division Between the Petro Government and the Mining Unions
Energy attorney Milton Montoya was mentioned in an article by El País about the new decree that changes the delimitation of natural reserves in Colombia and its impact on the mining sector. The decree grants the Ministry of the Environment the power to restrict current and future mining projects in protected areas for up to 10 years. Mr. Montoya expressed his concerns regarding the application of the rule to existing mining titles and their burden of subjectivity. He also pointed out that the rule could bring international lawsuits against Colombia for possible violations of treaties or contracts.
“We do not know how the new reserve power will be given to the chosen areas for 10 years. That is not a new issue, but it will affect mining activity for new and existing titles,” he said.
