Real Estate attorney Esteban García was quoted in an Asuntos Legales article about the legal requirements for renting a property through platforms such as Airbnb. Mr. García explained that Decree 2590 de 2009, Law 300 de 1996 and Law 1101 de 2006 govern the tourism sector with respect to "tourist housing services" such as those offered through Airbnb. In addition, the article noted the importance of properly declaring income in tax returns and making contributions to social security, sinceColombia's National Tax and Customs Directorate (DIAN) and Pension and Parafiscal Management Unit (UGPP) supervise the fulfillment of these obligations. Mr. García highlighted other considerations for those thinking about registering a home as a hosting option on a platform.
"The first thing you should take into account is if you are subject to a horizontal property and review this regulation to make sure this activity is allowed within the regulation," he said. "The second is before putting the property up to provide tourist services, you must comply with the established regulations: register in the National Tourism Registry and pay the parafiscal contribution for the tourism tax."
