Overview

Jeff Calk is a real estate attorney in Holland & Knight's Nashville office. Mr. Calk counsels hospital systems and healthcare clients helping them comply with healthcare regulations involved in complex real estate transactions. His focus is on commercial and healthcare real estate, including acute care and behavioral hospitals, senior housing facilities, medical office buildings and physician practices.

Compliance with healthcare laws and regulations is integral to real estate transactions between healthcare providers and referral sources. In the face of these complexities, Mr. Calk works to make matters as simple as possible for the client, especially when navigating Stark Law and Anti-Kickback statute issues. An effective communicator, Mr. Calk is solutions-oriented when advising clients on conducting their business.

Similarly, investors in healthcare real estate (whether medical office developers, healthcare REITS or physicians) seek Mr. Calk's counsel in negotiating transactions with hospital systems or other healthcare real estate investors.

On a day-to-day basis, Mr. Calk handles a variety of matters, including:

  • acquisition and development of medical office buildings
  • transactions to monetize healthcare real estate assets
  • needs of REITs in acquisitions, development projects, divestitures, financing transactions and leasing transactions involving a wide range of healthcare facilities

Evidencing his depth of experience and knowledge in the healthcare real estate sector, Mr. Calk serves as national leasing counsel for a publicly traded healthcare Real Estate Investment Trust (REIT).

  • Represented a publicly traded real estate investment trust (REIT) in the purchase and leaseback of a comprehensive inpatient rehabilitation hospital (IRF) in Indiana
  • Represented a publicly traded hospital company in the purchase of a ground lease interest in corporate office facility containing over 45 acres and over 300,000 square feet of office space in Tennessee
  • Represented a publicly traded hospital company in purchase of over 60 acres for future healthcare development in Florida
  • Represented a startup REIT in the purchase and leaseback of six properties used in a variety of cannabis related businesses in New Jersey, Massachusetts and Florida (with tenant being a publicly traded company on Canadian Securities Exchange)
  • Represented a healthcare REIT in the purchase and leaseback of 130-bed skilled nursing facility in Connecticut
  • Represented a healthcare REIT in purchase and leaseback of two drug and alcohol rehabilitation outpatient facilities (in Texas and Nevada) along with two companion lodging facilities occupied by patients of such outpatient facilities
  • Represented a senior housing REIT in the sale of seven senior housing facilities in Massachusetts and New Hampshire
  • Represented a publicly traded hospital company in purchasing three medical office buildings in Florida from a publicly traded healthcare REIT
  • Represented medical office building investor in the purchase of land in Alabama for the development of a cancer treatment center and subsequent sale of the developed property to third party.
  • Represented a medical office building investor in the sale and divestiture of six medical office properties in Alabama, Tennessee and North Carolina
  • Represented a publicly traded healthcare REIT in ground leasing land for development of a medical office building to be primarily leased to a ground landlord (hospital system) in Georgia
