Overview

Justin Cohen is a trial attorney in Holland & Knight's Dallas office, where he focuses on intellectual property (IP) litigation. Mr. Cohen has successfully taken cases to verdict and argued cases before the U.S. Court of Appeals for the Federal Circuit. Mr. Cohen has also represented clients in a variety of federal district courts, before the Patent Trial and Appeal Board (PTAB) and in the Trademark Trial and Appeal Board (TTAB).

The 2019 edition of the IAM Patent 1000 - The World's Leading Patent Professionals recognized Mr. Cohen as "instinctively incisive before a jury."

With a background in electrical engineering and prior industry experience in information technology, Mr. Cohen’s patent practice routinely handles cases in the areas of software, electrical, telecommunications and semiconductor technologies.

Mr. Cohen has extensive experience and routinely assists companies identify, evaluate, license and enforce their IP assets. Several prominent brand owners routinely rely on Mr. Cohen to help protect their brands from infringement.

  • Defended major semiconductor company in multiple patent infringement suits relating to capacitive touch circuits and related software
  • Defended major semiconductor company in six patent case involving semiconductor fabrication processes and structures
  • Defended a semiconductor developer in a Section 337 proceeding in the U.S. International Trade Commission relating to level shifter circuitry

  • Represented a patent holder in asserting a patent portfolio involving various aspects of personal computer power management against cell phone companies across multiple lawsuits
  • Represented patent owner of standard-essential patents in multiple licensing and litigation matters involving power-over-ethernet (IEEE 802.3af and 802.3bt), including serving as lead trial counsel in obtaining a jury verdict of infringement and validity, and successfully defeating multiple standards-related counterclaims and defenses in two jury trials, two appeals to the U.S. Court of Appeals for the Federal Circuit and numerous licensing mediations and negotiations
  • Defended a major airline in numerous patent infringement lawsuits related to secure payment systems, mobile applications, airport kiosks and encryption algorithms in federal district courts in Texas, Delaware and California

  • Defended a leading telecommunications infrastructure-equipment company and a wireless handset manufacturer in a patent infringement lawsuit related to 3G cellular-transmission protocols in the U.S. District Court for the Eastern District of Texas; obtained jury verdict of non-infringement and invalidity of all asserted patent claims
  • Defended a wireless handset manufacturer in several patent infringement lawsuits related to long term evolution (LTE), core processor functionality and user interface features in the U.S. District Court for the Eastern District of Texas

  • Represented country's largest real estate investing franchisor in various intellectual property (IP) and franchisee disputes, including protecting its famous trademarks from infringement and dilution in multiple district courts
  • Represented one of the country's largest grocery store chains in various IP issues, including district court litigation and various Trademark Trial and Appeal Board (TTAB) proceedings
  • Regularly advise franchisors and franchisees on IP issues
  • Defended a major supermarket chain and product suppliers against a trademark infringement lawsuit in the Southern District of Florida involving vegan product labeling
  • Represented a major airline in various trademark enforcement matters, including a trademark infringement lawsuit in the U.S. District Court for the Northern District of Texas
  • Represented a large nonprofit organization in various trademark enforcement matters, including a trademark infringement lawsuit to enforce its famous marks in the U.S. District Court for the Southern District of Florida
  • Represented a client with restaurants in several states in a contested concurrent use proceeding in the TTAB through trial; obtained opinion from the board granting the registration

  • Defended global investment firm in a copyright infringement lawsuit involving industry newsletters in the Northern District of Texas
  • Defended a large data center in a copyright infringement lawsuit related to software for managing its infrastructure and cloud hosting, co-location and website hosting services in the U.S. District Court for the Eastern District of Michigan

  • Defended a manufacturer of 3D printing/rapid prototyping machines in a patent infringement lawsuit related stereolithography technology in the U.S. District Court for the Eastern District of Michigan
