Overview

Emily M. Holpert is an attorney in Holland & Knight's Chicago office. Ms. Holpert focuses her practice on matters involving data privacy and security, technology transactions, intellectual property (IP) and information technology (IT).

Ms. Holpert has extensive experience advising clients on regulatory compliance obligations under applicable data security and privacy laws, including U.S. state breach notification laws, the California Consumer Privacy Act (CCPA), Gramm-Leach-Bliley Act (GLBA), European Union's (EU) General Data Protection Regulation (GDPR), Children Online Privacy Protection Act (COPPA), Family Educational Rights and Privacy Act (FERPA), as well as Health Insurance Portability and Accountability Act (HIPAA) and Health Information Technology for Economic and Clinical Health Act (HITECH). She also advises her clients on potential data breaches and assists with data breach responses and drafting regulatory and consumer notifications.

In addition, Ms. Holpert has experience drafting and reviewing privacy policies, terms of use, privacy notices and cookies policies for websites and applications to be compliant with all applicable data security and privacy laws for a wide range of clients, including public entities and developers of software platforms and mobile apps.

Ms. Holpert drafts and negotiates agreements and advises clients on a wide range of matters, including software license agreements, software-as-a-service (SaaS) agreements, outsourcing agreements, online terms and conditions, development agreements, end-user license agreements, master service agreements, transitional services agreements, open source development and usage, and reseller agreements. Her experience also includes performing IP due diligence and providing assessments in connection with merger and acquisition (M&A) transactions.

Ms. Holpert is a Certified Information Privacy Professional in the United States (CIPP/US).

Prior to joining Holland & Knight, Ms. Holpert was an attorney at multiple national law firms in their Chicago offices.
