Overview

Elissa McClure is a partner in Holland & Knight's Dallas and Newport Beach offices who focuses her practice on complex commercial litigation and corporate investigations. She advises clients, including Fortune 500 companies and individual executives, in all stages of disputes, from pre-litigation strategy through trial and appeal. Ms. McClure has extensive experience advising clients in connection with the False Claims Act (FCA) and the Anti-Kickback Statute (AKS), as well as government and corporate investigations involving the Foreign Corrupt Practices Act (FCPA), consumer protection, healthcare enforcement, trade secret misappropriation, discrimination, whistleblower, regulatory, accounting and securities fraud matters.

  • Represented a Fortune 200 client in a successful bench trial determining critical issues of first impression in client's favor, involving $100 million in dispute
  • Represented a Fortune 300 corporate officer in a federal action alleging conspiracy and fraud charges in connection with an approximately $30 million helicopter transaction involving a government entity and international banking institutions; all charges against client were dismissed
  • Represented a Fortune 500 client in litigation concerning bad faith and concealment allegations, involving multimillion-dollar disputes; case settled favorably
  • Represented a Fortune 500 client in litigation concerning multimillion-dollar disputes in connection with a consumer fraud class action; case settled favorably
  • Represented a publicly-traded entertainment company in connection with a class action alleging violations of consumer protection statutes; case settled favorably
  • Represented a publicly-traded cosmetics company in connection with a class action alleging violations of consumer protection statutes; case settled favorably
  • Numerous government and internal investigations involving the FCPA, consumer protection, healthcare enforcement, trade secret misappropriation, discrimination, whistleblower, regulatory, accounting and securities fraud issues. A representative set of those engagements includes:
    • Represented a Fortune 50 financial institution in connection with large-scale investigation before the U.S. Department of Justice and the U.S. Securities and Exchange Commission (SEC)
    • Conducted a global independent internal investigation concerning FCPA allegations at a publicly-traded company
    • Represented a publicly-traded healthcare company in an investigation by the Texas Office of Inspector General (OIG)
    • Conducted an internal investigation into discrimination claims at a publicly-traded company
    • Conducted an internal investigation in connection with a high-profile crisis management matter implicating a publicly-traded company
    • Conducted an internal investigation in connection with accounting fraud allegations at a publicly-traded company
    • Represented a healthcare company in an investigation concerning conspiracy, FCA and fraud allegations in connection with alleged kickback schemes
    • Conducted an internal investigation in connection with alleged international trade secret misappropriation at a global science and technology company

Prior to joining the firm, Ms. McClure served as a law clerk to the Honorable James C. Dever III of the U.S. District Court for the Eastern District of North Carolina. During law school, Ms. McClure was on the Editorial Board of the Duke Law Journal (law review).
