The Committee on Foreign Investment in the United States Says Chinese Investment in North Dakota Agricultural Land Is Outside its Jurisdiction
CFIUS and Industrial Security attorneys Antonia Tzinova, Robert Friedman and Marina Veljanovska O'Brien and paralegal Sarah Kaitlin Hubner wrote an article that was featured in the Journal of Federal Agency Action about a recent decision made by the Committee on Foreign Investment in the United States (CFIUS). CFIUS has determined that a greenfield investment in Grand Forks, North Dakota, by Fufeng Group, a Chinese food manufacturer, is not a covered transaction and therefore outside of its jurisdiction. This determination comes as federal and state legislators have expressed growing concerns over Chinese investments in U.S. agricultural land.
