Healthcare Transactions attorney John Saran was quoted in a Private Funds CFO article exploring how healthcare industry stakeholders are responding to increased state-level scrutiny of private equity involvement in the sector. States from California to Massachusetts have proposed and/or enacted a series of laws that expand merger review requirements, tighten corporate practice of medicine regulations and enhance antitrust enforcement mechanisms, among other provisions. Mr. Saran commented that providers need to band together to effectively advocate for their needs and push back against the narratives driving some of these legislative initiatives, meaning they need to form cohesive messaging and deliver that to state lawmakers.
"There needs to be an entire coalition. It's not just private equity," he said. "It's private equity, and it's the hospitals, and it's the physician practices, and the nursing homes and so son, all putting aside their differences and really dissecting these proposals and explaining what all this means for patient care."
