Overview

Juliet M. McBride is an attorney in Holland & Knight's Houston office and a member of the Healthcare Regulatory and Enforcement Practice Group. Ms. McBride has dedicated nearly 20 years to serving clients in the healthcare industry.

Ms. McBride's practice is focused on advising national clients across diverse healthcare sectors, including multistate health systems and non-hospital healthcare entities focused on innovative and direct-to-patient models such as wound care providers, medical equipment and device suppliers, mail-order pharmacies, manufacturers/distributors, healthcare technology companies, post-acute care entities and laboratories.

She frequently advises clients on varying issues, including government investigations, risk and compliance assessments, strategic refund assessments involving overpayment allegations, and payer disputes covering Medicare, Medicaid and commercial payers at state and federal levels. In addition, Ms. McBride has a significant background in serving as regulatory counsel for acquisitions involving medical suppliers and counseling companies on change management stemming from multimillion- and multibillion-dollar acquisitions. She maintains relationships with various state and federal government contacts for purposes of compliance queries and advocacy communications.

Ms. McBride has been ranked by Chambers USA – America's Leading Business Lawyers and The Best Lawyers in America guide, and as a thought leader in healthcare. She previously served as co-chair of the American Bar Association's (ABA) Washington Health Law Summit for three years, and often speaks and writes on healthcare issues for key publications. She is also a fellow of the ABA Foundation and a prior fellow of the Leadership Council on Legal Diversity (LCLD).

Prior to joining Holland & Knight, Ms. McBride worked for nearly two decades as a healthcare partner in the Houston office of an international law firm. While in law school, Ms. McBride served as a judicial intern for the Honorable Kenneth Hoyt in the U.S. District Court for the Southern District of Texas, the Honorable George C. Hanks Jr. in the Texas First District Court of Appeals and former Judge Marc Carter of the 228th Criminal District Court in Harris County, Texas.

Before her legal career, Ms. McBride was a marketing lead for an oncology-based medical education company.

Representative Experience

  • Represented numerous wound care providers in the defense of Unified Program Integrity Contractor (UPIC) audits and resultant payer appeals and disputes
  • Successfully represented a national medical supplier in a settlement with the Texas Office of Inspector General (OIG) stemming from alleged state Medicaid violations
  • Defended a statewide behavioral health organization through a Texas OIG Medicaid investigation leading to findings of no penalties or sanctions
  • Led a national medical supplier through its voluntary refund assessment across various government and commercial payers throughout the nation
  • Counseled a multi-state health system through the launch of its healthcare-at-home service lines, including hospital-at-home, remote patient monitoring, home health and other post-acute care capabilities
  • Advised a national telehealth platform in establishing a compliance program focused on the organization's transition from a cash-only business line to the payer market for reimbursable health services
  • Represented in-state and out-of-state pharmacies before the Texas State Board of Pharmacy
  • Defended a national distributor in a settlement with the Alabama Board of Pharmacy
  • Advised healthcare providers on a full range of legal issues surrounding Medicare reimbursement and advocated on their behalf before various administrative and judicial bodies, including Medicare cost report appeals before the Provider Reimbursement Review Board
  • Represented a national coalition of medical suppliers before the Tennessee Division of Health Care Facilities with respect to a favorable regulatory interpretation
  • Defended with team members a national laboratory in connection with a more than $31 million Medicare overpayment stemming from a Zone Program Integrity Contractor (ZPIC) post-payment claim audit with outcomes in favor of the laboratory
  • Represented national laboratories in connection with Medicare and Medicaid enrollment and billing issues, including specific involvement with various Medicaid programs for the national laboratories in connection with initial enrollment, revalidation, change of ownership requirements and ZPIC audit responses
  • Advised a large medical supplier chain with respect to regulatory and compliance concerns associated with various Medicaid programs
  • Successfully appealed ZPIC audit findings on behalf of a large health system
  • Counseled a number of multi-campus hospitals in connection with change of ownership Medicare enrollment and certification issues and state licensing requirements, including with respect to the hospitals' pharmacy and laboratory licenses and controlled substance permits
  • Successfully defended a hospital throughout administrative proceeding before the Texas Department of State Health Services with respect to state licensure requirements
