Law360

Labor and employment attorney Timothy Taylor was quoted in a Law360 article covering a federal appellate decision that sheds light on the challenges faced by employers as they navigate the remote work era. The U.S. Court of Appeals for the Fourth Circuit recently affirmed that Maryland's wage laws did not apply to two workers hired by a company based in the state but who never performed work there. Mr. Taylor explained the case underscores the need for careful consideration of various factors when determining which state laws will apply to remote employees, from where the employee typically works to where the employee could potentially work. His insights reveal a significant shift in how businesses and legal practitioners approach employment law in a work environment that is increasingly flexible.

"We have 50 laboratories of democracy, which sometimes can feel like 50 different tests as to whose law is going to apply," he said.
