Appeals Court Upholds Dismissal of OSR Enterprises' Trade Secret Lawsuit Against REE Automotive

Attorneys Bradley Hancock, Maria Gil, Mark Davis, Robert Hill and Gabriel Godoy were mentioned in a Texas Lawyer article recapping a federal appellate court decision upholding the dismissal of a trade secret and unfair competition case against their client REE Automotive Ltd. In the case, OSR Enterprises AG and OSR R&D Israel Ltd. accused REE of trade secret misappropriation after its head of research and development left OSR to join REE. OSR filed suit in the U.S. District Court for the Western District of Texas, which dismissed the case after concluding Israel would be a more appropriate forum, given that both OSR and REE are Israeli corporations. The U.S. Court of Appeals for the Fifth Circuit agreed with the district court, rejecting OSR's arguments that Israeli law would not adequately protect its interests.

"REE is pleased by the Fifth Circuit's decision rejecting OSR's position that Israel – where both OSR and REE call home – cannot sufficiently handle this matter," Mr. Hancock said in a statement following the appellate ruling. "OSR had argued that Israel's laws and judges were 'inadequate.' REE is fully confident that – should OSR press forward – the Israeli courts will serve justice and recognize OSR's unfounded claims for what they are: misguided attempts to suppress REE's revolutionary innovations and trusted partnerships."
