Holland & Knight Advises Construction Company Representative in Investigation by Colombian Competition Authority

BOGOTÁ (June 25, 2020) – Holland & Knight Partner Danilo Romero Raad and Associates Bettina Sojo and Camila López advised a former representative of engineering and construction firm Benton S.A.S., Monica Viviana Cristancho, in an anticompetitive practice investigation, where the Colombian Competition Authority accused corporations and individuals of colluding in the public bidding for the Bogotá – Girardot road project.

The new road will link Bogotá with Girardot, in the Cundinamarca and Tolima Departments of Colombia. Companies that faced scrutiny included Constructora Conconcreto S.A., Industrial Conconcreto S.A.S., Vinci Concessions Colombia S.A.S., ViA 40 Express S.A.S., Benton S.A.S. and China Gezhouba Group Company Ltd, along with several executives affiliated with those companies.

On June 16, by means of the Resolution 28751 of 2020, the Colombian Competition Authority decided to close the investigation initiated against the firms and individuals. The authority concluded that there was not enough evidence to prove that an anticompetitive agreement had existed, thus accepting the recommendation to close the investigation set forth in the Motivated Report of the Delegation for the Protection of Competition.
