Artificial Intelligence in Hiring: Diverging Federal, State Perspectives on AI in Employment?

Litigation attorneys Jennifer Lada and D'Andre Chapman co-authored an article in Employment Benefit Plan Review about President Donald Trump's executive order (EO), Removing Barriers to American Leadership in Artificial Intelligence, which cleared away policies seen as hindering innovation. The order followed President Trump's earlier action to reverse several Biden-era orders, including an EO that addressed discrimination and bias in artificial intelligence (AI) and suggested that AI systems for recruiting and hiring could worsen existing inequalities. This article highlights the major shift in U.S. AI policy and its implications for employers.
