America First Investment Policy: Presidential Memorandum Spells Out the Administration's Priorities for Inbound and Outbound Foreign Investments
International Trade attorneys Robert Friedman, Antonia Tzinova, Andrew McAllister, Libby Bloxom, Marina O'Brien and Cynthia Liu co-authored an article for The Global Trade Law Journal breaking down President Donald Trump's "America First Investment Policy." Published via a National Security Presidential Memorandum (NSPM), the policy outlines the Trump Administration's priorities regarding inbound and outbound investments. It focuses on reducing regulatory burdens for investments from U.S. allied and partner countries while at the same time heightening scrutiny of transactions involving foreign adversaries such as China, Iran, North Korea and Russia. This article analyzes the policies set forth in the NSPM, including a call to fast-track Committee on Foreign Investment in the United States (CFIUS) reviews and shift away from CFIUS mitigation agreements, as well as offers key takeaways for investors and companies engaging in international commerce.
