Jeremy D. Burkhart

Jeremy Burkhart is an experienced government contracts attorney in Holland & Knight's Tysons office. Mr. Burkhart focuses his practice on litigation, counseling, mergers and acquisitions (M&A), federal leasing and negotiating with the federal government. 

Mr. Burkhart leverages his significant experience in all aspects of government contracting, his 12 years of military experience and a vast network to solve his clients' problems. He provides counsel and representation on all government contract matters, including claims, subcontracts and teaming agreements, U.S. Small Business Administration (SBA) compliance requirements and size and status protests, and suspension and debarment. He is extremely well versed in prosecuting and defending bid protests, whether before the U.S. Government Accountability Office (GAO), U.S. Court of Federal Claims, Federal Aviation Administration's (FAA) Office of Dispute Resolution for Acquisition (ODRA) or at the agency level. Mr. Burkhart has litigated more than 100 bid protests. Mr. Burkhart also represents clients on procurement matters at the state and local level, and has handled bid protests of such procurements in Ohio, Maryland and Washington, D.C.   

Mr. Burkhart has significant experience representing clients across the spectrum of the Defense Industrial Base (DIB). This includes advising on the submission of white papers and proposals, as well as negotiating the terms of Technology Investment Agreements (TIAs) and Other Transaction Authority (OTA) Agreements. These agreements are not subject to the traditional rules applicable to government contracts (Federal Acquisition Regulation), and Mr. Burkhart uses this to protect his clients' intellectual property (IP) and data rights. He frequently negotiates favorable recipient cost shares for his clients, including one OTA where his client had no cost share requirement. Mr. Burkhart's knowledge of OTAs is widely recognized, and he frequently writes and speaks and writes on this topic. 

In addition, Mr. Burkhart regularly advises clients on federal leasing matters. He has represented several clients in lease disputes before the Civilian Board of Contract Appeals (CBCA) and U.S. Court of Federal Claims. These cases involved both traditional GSA leases and the Enhanced Use Lease (EUL) Authority of other federal agencies. 

He also has significant knowledge of the issues facing government contractors engaged in M&A and has represented clients in many such deals, as well as post-transaction matters such as novations.

Mr. Burkhart previously served on a presidential transition team, advising the incoming administration on federal procurement matters, and he maintains strong connections within government and industry. His articles frequently appear in legal and industry publications, and he is a regular contributor to Law360.

Prior to joining Holland & Knight, Mr. Burkhart served on active duty in the U.S. Army as a judge advocate general (JAG) for nine years, where he advised U.S. Department of Defense (DOD) officials on significant government acquisitions and regularly served as lead counsel in high-stakes litigation, including several jury trials. As a former agency counsel, Mr. Burkhart has substantial experience advising contracting officers and understands the government's priorities and concerns. He leverages this insight to craft strategies that successfully resolve clients' issues while preserving positive business relationships with government customers. Mr. Burkhart is a veteran of the Afghanistan war and continues to serve in the U.S. Army Reserve.
